At the April 2017 Annual Membership Meeting, voters approved the implementation of fines for violations to the Covenants Conditions & Restrictions (CC&Rs). At the April 2021 Annual Membership Meeting voters approved changes to the HSCA bylaws to allow liens to be placed on members’ properties should they not mitigate or pay fines on their violations of the CC&Rs. The Board of Directors appointed committee members to the ERC who meet monthly to review violations and issue decisions on sending out notifications, hearings, and fines. There is an appeal protocol should a member contest the ERC’s decisions which involves going to the HSCA board. Call the HSCA office for more detail (808 965-8140).
The ERC’s mission is to mediate solutions to gain compliance and stresses that fining will be imposed only as a last resort. HSCA staff is equally committed to reaching out to members to resolve issues and only after documented efforts to gain compliance have failed will matters be turned over to the ERC for review.
